1.Scope
These terms govern use of the website of the La Moda shop, operated by Atria d.o.o., Ivana Kukuljevića 4, 42000 Varaždin, Croatia. The company's registration details are on the Legal notice page.
By using the site you accept these terms. If you do not agree with them, please do not use the site.
2.What this site is
The site presents a physical shop in the centre of Varaždin. It is not an online shop: nothing can be ordered or bought through it, there are no prices and no cart, and no action on the site results in a contract of any kind.
Purchases happen in the shop, where Croatian consumer protection law applies to them.
3.Content and its accuracy
We publish the content in good faith and take care to keep it accurate and current. The brands carried, the selection and the opening hours may nonetheless change, and the photographs show the character of the selection rather than a list of items available at any given moment.
Always check the availability of a particular item, size or brand by calling +385 42 205 028 or writing to info@atria.com.hr. A brand or a product appearing on the site is not a promise that it is in stock at that moment.
4.Intellectual property
The text, design, layout and source code of this site are protected by copyright and belong to us or are used with the rights holder’s permission.
The photographs are supplier campaign material, used with their permission to present the shop’s selection. The names and marks of the brands shown belong to their respective owners and appear solely to inform customers what the shop carries; their presence does not imply that those owners are affiliated with us or endorse this site.
You may browse the content, print a copy for personal use, and share links to the site. Reproducing, republishing, altering or commercially exploiting the content without our written permission is not allowed.
5.Acceptable use
Use the site in a way that does not disrupt it or other visitors. You must not:
- attempt to gain unauthorised access to the site, its server or connected systems
- harvest content automatically in a way that burdens the server
- use the contact form to send unsolicited messages, advertising or malicious content
- use the site’s content in a way that misleads anyone about a connection with us
6.The contact form
The form on the Contact page is for enquiries about the shop’s selection. We forward the message to the shop’s mailbox and aim to reply within a day or two, but sending a message creates no obligation on our part and we do not guarantee a response time.
Do not enter confidential information or special categories of personal data into the form. How we handle what you send is explained in the Privacy policy.
7.Links to other sites
The site links to external sites, such as the shop’s social media profiles and a map of its location. We are not responsible for their content or availability, and opening such a link takes you off this site and under the terms of its owner.
8.Availability
We aim to keep the site continuously available but do not guarantee it. Access may be interrupted for maintenance, a technical fault, or circumstances beyond our control. We reserve the right to change, restrict or discontinue any part of the site without prior notice.
9.Limitation of liability
We are not liable for damage arising from the use of, or inability to use, this site, nor for decisions taken solely on the basis of its content, to the extent such a limitation is permitted by law.
Nothing here excludes or limits liability for intent or gross negligence, for damage to life and health, or any rights consumers have under mandatory law.
10.Consumer complaints
You may submit a written complaint about our conduct of business in the shop, by post to Ivana Kukuljevića 4, 42000 Varaždin, Croatia, or by email to info@atria.com.hr.
We will reply in writing within 15 days of receiving it at the latest, as required by the Croatian Consumer Protection Act. So that we can reply, please include your name and your postal or email address.
11.Changes to these terms
We may revise these terms when the content or functionality of the site changes. A revised version applies from the day it is published, and the date of the last revision is at the top of this page.
12.Governing law and jurisdiction
These terms and the use of the site are governed by the law of the Republic of Croatia. The competent court in Varaždin has jurisdiction over disputes, save that consumers retain the right to bring proceedings before the court of their domicile where mandatory law gives them that right.
